Before commencing the engagement and initiating transactions, we require contracts to be in place. Being a 100% Export Oriented Unit and a unit under the Software Technology Parks of India (STPI), Bangalore, which is a government of India undertaking, all our contracts are filed with STPI periodically.

Our perspective of a contract is not just ‘legal’

We document the framework of understanding on the engagement and call it the contract. Of course, it is very much legally enforceable. However, since we would have already confirmed a win-win relationship before consolidating the contract, the contract serves as the framework of understanding and therefore a reference document whenever clarifications are required.

The contract would define clearly the terms of engagement. It also addresses the important area of risk management. This is important since the contract governs a framework of understanding between two entities that may never see each other face to face during the lifetime of the project. Risk is well mitigated for both parties in the contractual relationship by tying up specific project deliverables to the payment schedules.
